These Terms of Service ("Terms") govern your use of peakperformanceathletellc.com (the "Site") and the mental performance coaching, tutoring, and team programs offered by Peak Performance Athlete LLC, doing business as Peak Performance Coaching ("Peak Performance," "we," "us," or "our"). By using the Site, submitting a form, booking a call, or enrolling in a program, you agree to these Terms.
1. Our Services
Peak Performance provides mental performance coaching, self-assessments, educational content, team programs, and academic tutoring for student-athletes, parents, and coaches. Our coaching is educational and skill-building in nature — it is not medical care, psychotherapy, or a substitute for treatment by a licensed mental health professional.
2. Quizzes and Assessments
Our Competitor Style, Communication Style, and other self-assessments are informal, self-reported tools designed to build self-awareness. They are not clinical or diagnostic instruments, and results should be treated as a starting point for conversation and reflection — not a definitive or scientific classification of you or your athlete.
3. Eligibility and Minors
Many of our services are designed for student-athletes who are minors. If you are under 18, a parent or legal guardian must review and agree to these Terms on your behalf, and must be involved in booking, billing, and communication for your sessions or tutoring. By submitting an intake form or scheduling a session for a minor, you confirm that you are that minor's parent or legal guardian, or are otherwise authorized to act on their behalf.
4. Bookings, Scheduling, and Cancellations
Discovery calls and sessions are scheduled through our Calendly booking links. Please provide at least 24 hours' notice if you need to reschedule or cancel a booked session; late cancellations or no-shows may be subject to our standard rescheduling terms, which we'll communicate directly with you.
5. Pricing and Payment
Pricing for individual sessions, team programs, and tutoring is discussed and confirmed directly with you at the time of booking, outside of this Site. Payment terms will be provided at that time. We do not process payment card information through the Site itself.
6. Intellectual Property
All content on this Site — including our written materials, quizzes, frameworks, branding, and newsletter editions — is the property of Peak Performance Athlete LLC and may not be copied, reproduced, or distributed without our permission, except for your own personal, non-commercial use.
7. Acceptable Use
You agree to use this Site honestly and lawfully — including providing accurate information on intake forms and quizzes, and not attempting to disrupt or misuse the Site's forms, booking tools, or content.
8. Disclaimers and Limitation of Liability
The Site and our coaching content are provided "as is." While we're committed to helping athletes, coaches, and parents build stronger mental performance skills, we cannot guarantee specific outcomes, results, or performance improvements. To the fullest extent permitted by law, Peak Performance Athlete LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or our services.
9. Governing Law
These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law principles.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the updated Terms.
